I would say that Foveon do not have the patent to making color sensors based on wavelength dependent behaviour in silicon or any other semiconductor. They have the patents they have, describing explicit designs.

And they do absolutely not have any patents blocking layered color sensors in general. This is such an obvious claim that it cannot be patentable.

So - I assume its fully possible that someone comes up with something different or even similar, that is not covered by any Foveon patents.

Of course, in an US court Sigma/Foveon might win nevertheless. US courts seems to favour US inventions.
