I'd say no unless you have the permission of the hospital, the patient's family and it doesn't upset the patient. Also what is your motivation? Are you simply trying to get a good or "interesting" photo, or are you trying to seriously document and show how dementia patients are treated - or something like that?

Anyway, since you ask whether taking such a photo is "fair game" - I'd say it clearly isn't.

BTW The thread you linked to has now been withdrawn - so I haven't seen it.
