Canon S95 flash problem...is it a design flaw?

Hi,

I'm currently "in negotiation" with John Lewis as my Canon s95 has developed the "wrong flash position" error and is just 5 months out of it's standard 1 year warrantee.

I've tried the couple of solutions I@ve read about on various forums (update firmware, try forcing flash up manually then restart over and over) to no avail, and am trying to get John Lewis to pay for repairs under the sale of goods act. I have read that this is a well known design flaw in the s95 and s100 cameras but am having trouble finding nay "expert" documentation online that I can show to John Lewis to argue my case.

Has anyone here successfully got their camera repaired under sale of goods act, or know where I can find confirmation that this error is a known design flaw and was therefore present when I purchased the camera?
