Would you return/haggle with open box camera sold as new?

I just got a new X100 today from an online retailer.

The camera box was pretty scuffed-up, which I thought odd.

I charged the battery, inserted and formatted the SD card, and turned on the camera.

It started right up, but not on the "select a language' screen. Hmmm.

My understanding is that "open box" items should be discounted -- and I should have known this before I bought it.

I know this has been debated in the past here on DPR; how many here would call the retailer and ask for a discount or even exchange the camera?
