Images of property used editorially

Can anyone help here......

...I supply photographs to a travel company within the UK.

Some images I would like to supply feature private property which they may want to use editorially within their brochure.

I'm aware of the advertising vs editorial thing - but I'm not sure whether such use is regarded as advertising? The brochure is a general advertising medium for holidays in the area, not for those properties.

The properties we are talking about are owned by national organisations such as 'English Heritage', so we're not talking individual's homes or anything.

I've heard horror stories about the British Organisation 'National Trust' taking photographers to court but I'm not sure of their circumstances.

Can anyone advise on the issue?

I know a lot of folks are in USA, and not sure if law is different there?
