I must have gotten lucky. I have the Tamron lens on my D800 and it seems to work just fine. I have not run really extensive tests, rather, I have just shot dozens of photos at many focal lengths and apertures. I have not noticed any focus problems.
Also, I keep the VC on all the time and I have not seen any blur or loss of detail at any of the higher shutter speeds.
I have not checked for the mis-aligned aperture lever, so I can't comment on that issue.
In general, this lens has performed well for me. Note, I have never tried either the Nikon 24-120 or the 24-70, so I cannot compare image quality.
I suggest you try another copy of the lens just to make sure you are not giving up too soon.
