I bought it brand new, it had issue with shutter assembly couple of months back at very low number (think it was about 50k or so.)
I noticed the AF recently and decided to perform more tests which confirmed my feelings

Wow, that bites! Sorry to see that you're having issues with it. Did you buy yours new, recently?
I have a d3s that I bought used, back in Feb, 2012. I've not had to formally test it because all of my preliminary and subsequent normal shooting haven't indicated a problem. It's a wonderful camera, when it works.
Regardless, I hope you get it resolved quickly.
