Currently have D300s and D200. Using 70-200mm F2.8, 17-55mm F2.8, 50mm F1.4, a few SB900/SB800 flashes, etc.,

I have the 70-200mm f/2.8 VRI and it is a bit weak in the corners on the D800E. I hear the VRII is much better. The 17-55mm is a DX lens, so you wont be able to use its full range on a D800. Somewhere in the wide range it will vignette horribly. Your flashes will work fine.

Would like to get D800 and maybe 24-70 F2.8 as a package.

Buy them together and save $200. The 24-70 is a decent lens on the D800E, but it does start to show its weaknesses at 24mm and 70mm. Its mid-range is better. You would need excellent primes to better it.

Read there are issue with AF at the moment.

Not with all of them. My D800E has no AF problem. There is rumor that Nikon may have fixed it in production by now. Might be true, might not.

How serious is the issue, are there any other issues?

Reports vary from minor to major to no problem. You feeling lucky...

Should I want or can I purchase it?

I have no idea what you desire, nor what you are capable of doing.

Would prefer to purchase it before Amazon start charging Sales Tax to California.

You will still owe the taxes, but chances are you wont be caught. Since I have a resale license, I paid sales tax for my D800E when I filed my quarterly report.

Is D800 way over hyped at the moment. Get D700 instead? I don't really care for the video feature, it is just an added bonus. my D300s already does video and I rarely uses it as it is.

If you don't need or want the resolution, and DR is not a big deal to you, then the D800E wont have much advantage for you over a D700.
