Nope - the Copyright Designs and Patents Act 1980 requires that a work contain as "substantial" amount of the copyrighted work before it be infringing. A still capturing less than one second of a stage performance cannot reasonably be argued to constitute a substantial portion of it. Therefore, the judge was correct according to the law.
