Photo used for print ad without permission - seeking advice
Jul 25, 2012

Hello all,

I am hoping to get some advice and learn from others what my options are in this situation and how to proceed from here with the matter at hand.

I was contacted by a friend who noticed a photo (of him) I had taken that was used by a company in one of their magazine advertisements. He was asking if I knew anything about this and alas I did not.

As far as I know this ad is in one magazine currently; I am going to check other magazines of the same nature to confirm if it has been used in other publications. I have researched the company and their website and have found no sign of the image being used online.

I have not contacted the company yet but I fully intend to be compensated for the unauthorized use of the image. I take this very seriously and am not pleased with their actions but I want to go about this in the most civil and level-headed manner possible.

Can anyone out there provide advice/suggestions/resources on how to proceed?

Additional information on the situation is that the photo is not the entire ad but a portion of it, I believe they acquired it from a site that I contribute to and it is not a stock photography site like Getty, and it is in a magazine distributed across the United States.

Thank you for your help.
Andy Kawa
