Your argument would hold up if the action taken had occured inside the United States.
Your protagonist was killed in a foreign country.
The action can be easily justified as an act of war.

The fact that we are not at war with the country in which the action occured is irrelevant.

The action was directed against the enemies of the government of that nation and had the approval of that government.
In short, it was legal. It was not "extraconstitutional".
