Viewing this situation as a legal issue isn't the best way to go about it. First there's the obvious; do you really want legal advice from a bunch of photographers? And second, do you really want a court to sort things out for you?
My experience is that getting releases in this situation is a really good idea because if you do it properly, it will make you look more professional and make the subjects of your images more curious to see them - and perhaps purchase images from you.
I've also found that often enough, asking for releases will make subjects behave more professionally and take a shoot more seriously too.
Remember, you get a chance to introduce yourself, remind people that you're not a sneak (or worse), and flatter them by telling them that what they're doing is worth photographing and publishing.
