btw, members of MADD (Mothers Against Driving Drunk) know these situations are not "accidents." They are crashes. Hopefully you will respect the pain these surviving family members suffer and use the correct term, and ask your local media to do the same.
I am sorry for your loss.
My brother was killed by a drunk driver on St. Patrick's Day some years back. The woman he was with survived, but her unborn child did not. The perpetrator was of course drunk and had no insurance. There were some additional aggravating circumstances. It ended up with two counts of Gross Vehicular Manslaughter.
He did not have any assets, nothing certainly enough to ever compensate her or us for the losses. He literally was broke. He got fifteen years and served 36 months or so. He also took got a felony strike (as in three strikes your out)... maybe two. i forget. It was not enough.
You are right about using proper terms. These are the foreseeable result of negligent acts. I'll buy "crashes" for lack of a better term. They are not accidents.
I tell you this, driving while distracted is no better. they have measured this and have determined that it is the same as driving impaired. anyone reading this that does it... texting, phone calls, whatever, just remember that your phone records can be had. If they show you were likely improperly on the phone at the time, you are going to suffer a very, very long road. Same deal as drunk driving... up to and including Gross Vehicular Manslaughter.
