60 shots isn't necessarily a whole lot. You could get that many from customers checking out the camera in the store. 6 shots from 10 customers. 10 shots from 6 customers. It could be a 'display' item. Is a display item "new"? You might get different opinions on that. An untidy box could just be due to salespeople that don't care. If it looks perfectly "new" I myself would not be concerned about the 60 shutter clicks, (but would be doubly sure about any warranty or guarantee.)

The battery is a different matter. If in fact the camera is supplied from the manufacturer with a battery (majority are) then you are owed a battery; regardless if the camera is new OR used, (unless there was a stipulation at purchase time that a battery was not included.

If you decide to keep it, "good luck" with it.
