Sigma 24-70mm f2.8 HSM misfocuses too much

Does anybody know if it is a known problem with these Sigmas misfocusing more than they should? Or is the D700 needs to be fine tuned to work with that thing. Or should I send it to Sigma to get checked? When it does focus, it produces outstanding results.
