Photographer selling photos from private party

This is a new one for me. What are your thoughts.

My duaghter is the maid of honor for her best friend. They had a bachelorette party, rented a bus and went bar hopping.

The sister of the bride claims to be a professional photographer (debatable) and she said she would bring along her camera to take some pictures. She was not hired by anyone.

She has now put the photos online at a photo selling site. They are all watermarked and she is selling them for 5 bucks for a 4x6. She refuses to give them to anyone.

My kid grabbed a screen shot for her online profile picture. She just received a threatening email from the so called photographer claiming she just reported her for copyright infringement to the photo selling site.

I think the whole thing is amusing but my kid now wants to mess with her.

Not being the hired photographer can she even sell the photos without a model release? Or is the photographer within her rights to do this?

Any help would be appreciated.
