Your camera shutter is on its way out.

I had a brand new D3 out of the box with exactly the same fault.

Nikon shutters have a built in mechanism for measuring the actual speed of the shutter.

So if its set at 1/1000 of a second it will measure it. As the shutter gets older, it obviously slows down, wear and tear ect, but it will still measure the speed of the shutter. so instead of it being 1/1000 it might be 1/989. It remembers these settings and uses them for calculating the exposures.

Now, if the shutter is outside of a certain tollerance, then you get the err on the top display and your images are either over or under exposed. This needs repairing!!
depending on the age of your camera, you might get it done under warranty.

Most of the responses here are to do with the other ERR error when you have not set your manual aperture to its maximum setting and the fact that the camera can not see the correct aperture, and correctly cleaning the contacts will help in that situation.
