Falsely accused?

I saw this story on the New Zealand consumer rights TV show 'Fair Go tonight. A lady featured says she took a photo of a tree under a double rainbow, but that this image was stolen and appears on numerous websites across the US and elsewhere. As mentioned in the story, the photographer at Missouri Skies claims credit for the shot. You can see it here on his website: http://www.missouriskies.org/rainbow/february_rainbow_2006.html

But the US photographer has a number of shots at various different angles of the same tree, including one in summertime with leaves on the tree, leading me to think he has to be the legitimate photographer of the photograph, and I wonder in the TV show checked its facts properly before airing the story. What do you photogs think?
