Here is a response I got from a person when I'd asked him to remove photos of mine from his site.

"Title 17 U.S.C. Section 107 and fully review it before you
try and preach it have them explain it to you in depth as my
web site is with out profit or payment for non-profit research
and educational purposes only and is also one step more it is
ALL open source."

Is there any validity to his argument that since his site is not for profit, etc. that he has free reign to use my work?
