bogen 3021bpro's neck twists.. some concerns.

I just bought the bogen 3021bpro after long deliberation between the shorter 3001 and boy am i glad i went supersize. But im not too happy with the neck rotating even when locked. is this natural? those who have this tripod can you still turn the neck (the one that holds the neck with the octagonally shaped holes) even when fully locked? I can but only when i force it to...i know it might not be necessary but i think this thing is rocksolid when locked.

Im also concerned about the legs which is eighter too tight or too loose. I kinda wished it had older bogen tripods which had a twist-to-lock knob mechanism. Has anyone every experienced it unlocking itself by accident?
