70-200/4L Why does Canon still sell this lemon?

Only recently I entered the Canon world by buying a 20d + 17-40/4L lens. I did this together with the firm decision to immediately add a 70-200/4L for its performance together with a pleasant weight.

Now after reading through the available information I find it more and more questionable if the 70-200/4 is a useful lens at all. A lot of people report that the lens has a backfocus problem at lower focal lengths. This problem seems to be as well very common and difficult to fix. Do you agree that this lens is a lemon at least for digital? Will I avoid these problems by choosing a 70-200/2.8 instead?
