Can a Daycare force an Image Release?

My wife came home with a memo from my sons daycare stating that

"XYZ Daycare can photograph my child for use in printed brochures, website advertising and other marketing related materials. Such photographs are property of XYZ Daycare and may not be reproduced without permission from the Company President or Designee"

When I saw this I flipped. While I understand they may photograph the rooms and what not with kids in it, I'm not about to sign away rights to the photos without seeing them first.

I mean, I'm all for them trying to further the business, but I'm also not paying $10k per year for them to go and use my sons image for free if at all.

What are your thoughts? As of now, I'm taking this back to them and telling them no way. If my son appears in a photo then they can show it to me and the wording of the contract...well, it would have to be redone.
